Terms of Service

By using Cyberience Project Manager, a service of Cyberience Internet Solutions, you are agreeing to the following Terms of Service, which may be updated from time to time without notice to you.

You are responsible for regularly reviewing these Terms of Service and additional terms posted on this Site. Your continued use of this Site constitutes your agreement to all such terms, conditions, and notices.

Description of Service

Cyberience Internet Solutions provides users with access to the Cyberience Project Manager application ("service").

You may connect to the service using any Internet browser. You are responsible for gaining access to the Service and that access may involve third party fees (such as Internet service provider). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service.

You may create, edit, publish and share the contents of your Accounts. You are responsible for the contents of your Account and Account information and Cyberience Internet Solutions shall not be responsible for deletion, failure to store or unauthorized access to the contents of your Account. The contents of the Accounts are created by persons over whom Cyberience Internet Solutions does not exercise any control and Cyberience Internet Solutions does not assume responsibility for the same.

Unless explicitly stated otherwise, any new features or modifications to the current Cyberience Project Manager, or any service or hosted application offered or operated by Cyberience Internet Solutions, shall be subject to these Terms of Use.

Your Obligations

In consideration of your use of the Services, you agree to: a) provide true, accurate, current and complete information about yourself as prompted by the Registration Process; and b) maintain and promptly update your Registration data to keep it true, accurate, current, and complete.

If you provide any information that is untrue, inaccurate, outdated, or incomplete, or if Cyberience Internet Solutions has reasonable grounds to suspect that such information is untrue, inaccurate, outdated, or incomplete, Cyberience Internet Solutions has the right to terminate your Membership and refuse current or future use of any or all of the Services.

• You must be 13 years or older to use this Service
• Accounts registered by automated methods are not permitted
• You must provide a valid email address, and any other information requested in order to complete the signup process.
• Your login may only be used by one person – a single login shared by multiple people is not permitted.
• You are responsible for maintaining the security of your account and password. Cyberience Internet Solutions cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• You are responsible for all Content posted and activity that occurs under your account (even when Content is posted by others who have accounts under your account).
• You may not use the Service for any illegal or unauthorised purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Fees and Payments

Cyberience Internet Solutions reserves the right at any time to charge or modify fees for access to portions or whole of any or all of the Services. However, such fees shall not be charged unless your prior agreement to pay such charges is obtained. Thus, if at any time Cyberience Internet Solutions requires a fee for any of the Services, you will be given reasonable advance notice of such fees and the opportunity to cancel your membership before such charges are imposed. If you elect not to pay any fees charged by Cyberience Internet Solutions, Cyberience Internet Solutions shall have the right to cease providing the Service to you.

Cyberience Internet Solutions has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Cyberience Internet Solutions service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account.

Privacy Policy

Personal information you provide to Cyberience Internet Solutions through the Service is governed by Cyberience Internet Solutions Privacy Policy and applicable laws related to personal information. Your election to use the Service indicates your acceptance of the terms of the Cyberience Internet Solutions Privacy Policy. You are responsible for maintaining the confidentiality of your Account information and other sensitive information. You are responsible for all activities that occur in your Account and you agree to notify Cyberience Internet Solutions immediately of any unauthorised Account use. Cyberience Internet Solutions is in no way responsible for any loss or damage to you or to any third party incurred as a result of any unauthorised access and/or use of your Member Account, or otherwise

Copyright and Content Ownership

• We claim no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours. However, by setting your pages to be shared publicly, you agree to allow others to view and share your Content.
• Cyberience Internet Solutions does not pre-screen Content, but Cyberience Internet Solutions have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service.

General Conditions

• Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis.
• Technical support is only provided to paying account holders and is only available via email.
• You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Cyberience Internet Solutions, or any other Cyberience Internet Solutions service.
• We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use.
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Cyberience Internet Solutions customer, employee, member, or officer will result in immediate account termination.
• You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
• You must not upload, post, host, or transmit unsolicited email, SMS, or “spam” messages.
• You must not transmit any worms or viruses or any code of a destructive nature.
• If your bandwidth usage significantly exceeds the average bandwidth usage (as determined solely by Cyberience Internet Solutions) of other customers, we reserve the right to immediately disable your account or throttle your file hosting until you can reduce your bandwidth consumption.
• Cyberience Internet Solutions does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
• You expressly understand and agree that Cyberience Internet Solutions shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Cyberience Internet Solutions has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
• The failure of Cyberience Internet Solutions to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. The Terms of Use constitutes the entire agreement between you and Cyberience Internet Solutions and govern your use of the Service, superceding any prior agreements between you and Cyberience Internet Solutions (including, but not limited to, any prior versions of the Terms of Use).
• Please report any violations of the Terms of Use to Cyberience Internet Solutions.
